Welcome to Excelsior Business Academy (“EBA,” “we,” “us,” or “our”). By accessing or subscribing to any of our services, platforms, or programs, you agree to the following Terms of Service. These terms are designed to protect both you (the “Client”) and Excelsior Business Academy.
1. Overview of Services
Excelsior Business Academy provides business education, software access, marketing systems, automation tools, and consulting services for business owners and entrepreneurs.
We offer multiple service tiers, including:
- System Access (Starter Tier) – DIY platform access and foundational tools.
- Growth Tier – Platform access with onboarding and strategic support.
- Enterprise Tier – Done-for-you marketing and operational services.
Each tier includes specific features outlined on its respective proposal and/or sales page. We reserve the right to update or enhance platform features as technology evolves.
2. System Access (Starter Tier) – Free Trial & Recurring Billing
The System Access plan includes a 7-day free trial. By enrolling in the free trial, you authorize Excelsior Business Academy to charge the payment method provided at the conclusion of the trial period unless you cancel prior to the trial expiration. After the 7-day trial ends, your subscription will automatically convert to a paid monthly membership at $97 per month.
Subscriptions renew automatically every 30 days unless canceled before the next billing date. No refunds will be issued once a billing cycle has begun. Access remains active until the end of the current billing period after cancellation. Excelsior reserves the right to deny repeated free trial access if trial abuse is suspected.
3. Billing & Payment Terms (All Tiers)
All subscriptions are billed automatically on a recurring basis unless otherwise specified in writing.
You agree to:
- Provide accurate and current billing information.
- Maintain a valid payment method on file.
- Authorize recurring charges according to your selected plan.
- Failed payments may result in temporary suspension of account access until payment is resolved.
We reserve the right to update pricing with reasonable notice to subscribers.
4. Cancellation Policy
You may cancel your subscription at any time prior to your next billing date.
Cancellations:
- Must occur before the next billing cycle to avoid future charges.
- Do not result in prorated refunds.
- Maintain access through the end of the current billing period.
- Enterprise Tier clients may be subject to minimum commitment periods as outlined in their agreement.
5. Refund Policy
Due to the digital nature of our services and immediate access to proprietary systems, all payments are non-refundable once processed.
This includes:
- Monthly subscription fees
- Setup fees (if applicable)
- Consulting services rendered
6. Intellectual Property & Platform Usage
All systems, automations, templates, workflows, marketing assets, and educational materials provided by Excelsior Business Academy remain the intellectual property of EBA unless otherwise agreed in writing.
By subscribing, you agree:
- Access is granted for your business use only.
- Login credentials may not be shared.
- Templates, workflows, or systems may not be copied, resold, redistributed, or white-labeled without written permission.
- Platform access may not be used to replicate EBA systems for resale.
- Violation of these terms may result in immediate account termination without refund.
7. Support & Communication
System Access (Starter Tier) includes platform access only. Strategy sessions, implementation support, or done-for-you services are not included unless separately purchased. Support is available via email during standard business hours (Monday–Friday, 9am–5pm CST). Response times are typically 1–2 business days.

8. Client Responsibilities
Clients are responsible for:
- Complying with all applicable laws (including CAN-SPAM, GDPR, data privacy regulations, etc.)
- Ethical use of the platform
- Maintaining secure login credentials
- Ensuring all marketing communications are compliant with relevant regulations
Excelsior Business Academy is not responsible for misuse of the system by the client.
9. Performance Disclaimer
Excelsior Business Academy provides tools, systems, and strategies designed to support business growth. However, we make no guarantees regarding specific financial results, revenue, or business outcomes.
Success depends on implementation, market conditions, and individual effort.
10. Payment Disputes & Chargebacks
By purchasing our services, you agree to contact Excelsior Business Academy directly to resolve billing concerns before initiating a dispute or chargeback with your financial institution. Fraudulent chargebacks may result in immediate account termination and permanent removal of access.
We reserve the right to pursue collection of unpaid balances.
11. Limitation of Liability
Excelsior Business Academy shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services. The platform is provided “as is” without warranties of any kind. Our total liability shall not exceed the amount paid by the client in the preceding 30 days.
12. Confidentiality
Any sensitive business information shared with Excelsior will be kept confidential and used solely for fulfilling agreed services. We take reasonable measures to protect client data but cannot guarantee absolute security.
13. Amendments
Excelsior Business Academy reserves the right to update these Terms of Service at any time. Continued use of our services after changes constitutes acceptance of the updated terms.
